NEW YORK (Reuters) - CBS will go to court Wednesday to fight an attempt to block the broadcast of its news division's investigation of a major chain of psychiatric hospitals, the television network said.
CBS said in a statement that Charter Behavioral Health Systems, the United States' largest psychiatric hospital chain, sought a temporary restraining order against it Tuesday in U.S. District Court in Charlotte, North Carolina.
Charter is trying to block Wednesday night's broadcast of a "60 Minutes II" report on "dangerous conditions and falsified records" at its facilities, CBS said.
The network said the U.S. Supreme Court had consistently ruled unconstitutional the sort of prior restraint being sought and expressed its intention to oppose the company's motion Wednesday in the same court.
Andrew Heyward, president of CBS News, said the hour-long report on the hospital chain "serves the public interest in exploring an issue of critical importance to families across the country."
Atlanta-based Charter provides psychiatric and substance-abuse services at 92 locations in the United States. It is equally owned by Magellan Health Services Inc. of Atlanta and Crescent Operating Inc. of Forth Worth, Texas.

Charter Behavioral Health Systems, which runs 91 hospitals in 32 states, including South Carolina, accused CBS of violating patient confidentiality by sending a worker into a Charter facility in Charlotte with a tiny camera on his eyeglasses.
Using the hidden camera, clinical worker Terrance Johnson allegedly documented cases of falsified records and patient mistreatment.
The hidden camera footage that was broadcast showed his conversations with staff workers who changed the vital signs on one patient's chart without checking the patient. The workers also complained of having little training. Another portion showed workers restraining a screaming girl who had not been informed she was being committed.
In arguing its case, CBS News officials said patient confidentiality was not compromised by the "60 Minutes II" report because the faces of those filmed were blurred and their voices altered.
Despite that, attorneys for the health system said several patients were worried they might be identified in the report.
John Wester, another Charter attorney, said CBS committed a crime by using the hidden camera. He said the program also violated patients' privacy.
CBS attorney Lee Levine said the report needed to be broadcast because it raised important questions about the quality of care at psychiatric hospitals.
U.S. District Judge Graham Mullen expressed concerned that laws might have been broken in assembling the hidden-camera report but said he had no choice but to deny the motion.
