Sexual Assault



Psychologist Gives up Licence after Sexual Misconduct Charges
Los Angeles, Calif source: Los Angeles Times, January 22, 1998
   Covina psychologist Eric Gustafson is accused of having a five year sexual relationship with a 37-year-old female patient who had been hospitalized for depression. Gustafson surrendered his license for a three year suspension.


Sexual Rampage - The Psychiatrist and the Child Molester
Costa Mesa, Calif source: Orange County Register, February 4, 1998 and the Los Angeles Times, May 6 & 7, 1998
   Psychiatrist Burnell Forgey, 80, admitted guilt to 20 pages of allegations, that he was sharing his home with James Crummel, a career sex criminal who is suspected of killing a Costa Mesa boy, and took Crummel on rounds with him to youth group homes, where Crummel was allowed to roam free, left alone with the youths and given access to the youths' files. One of Crummel's sexual molestations was so violent he nearly beat a boy to death with a tree branch. He is now in custody on murder and sexual molestation charges, awaiting trial in San Bernardino County. Forgey is suspected of sexually assaulting a 16-year-old patient and having oral sex with him, while Crummel allegedly sodomized and orally copulated the boy. Crummel's rap sheet spans decades and includes a conviction of murdering a 9-year-old boy, which was overturned by a judge. Police are looking for other possible victims. Forgey surrendered his medical license after admitting that he was guilty as charged.


UPDATE: Psychiatrist DeGuzman Sentenced to 3-4 Years in Prison, then 15 Years Probation for Sexual Molestation of Young Male Patients

   Psychiatrist Antonio DeGuzman, 43, of Duxbury and Pembroke Hospital, was found guilty and sentenced to prison for 3 to 4 years in a state prison for preying on troubled young boys when they were most vulnerable. The jury found DeGuzman guilty of five counts of indecent assault and battery on a child over 14, involving three former male victims who were patients at Pembroke Hospital where DeGuzman was the admitting officer for 10 years. Following his prison sentence, DeGuzman will serve 15 years' probation during which time he is banned from any contacts with males below the age of 18. Said the prosecutor, "Sexual assaults against young people are bad enough, but when that person is a physician in a white coat with a stethoscope, it is very hard to understand that he is a devil in disguise."


Psychologist Loses License for Sexual Misconduct with a Patient
Huntington Beach, Calif Source: Orange County Register Feb 7, 1998
   The license of psychologist Patricia Breit has been revoked by the Department of Consumer Affairs' Board of Psychology, for sexual misconduct with a patient. The board has also found her guilty of gross negligence and unprofessional conduct, and liable for $7,500 for costs of investigation and enforcement.


Child Psychologist Pleads Guilty to Indecent Assault and Endangering Welfare of Children

   Child Psychologist James E. Wetzel, 48, of Monroeville, pleaded guilty to charges that he fondled two boys during counseling, pleading guilty to three counts of aggravated indecent assault and two counts each of corrupting minors and endangering the welfare of children. Each of the charges carries a possible 2 1/2 to five years in prison. The boys were 11 and 12 years old when the incidents occurred. The state board will determine if Wetzel is to be labeled a sexually violent predator and placed on life parole after completion of any prison term. Wetzel was on the list of court-appointed child psychologists.

Psychiatrist Sentenced to Prison for Medicare/Medicaid Fraud
Tampa, Florida source: Tampa Tribune, April 8, 1998
   Psychiatrist Nestor A. Garcia, 43, was found guilty of submitting bills of more than $4.5 million to Medicare and Medicaid between 1994 and 1995 and was sentenced to 6 1/2 years in federal prison. He was ordered to repay nearly $1.7 million. Garcia was also ordered to serve three years of probation after his prison term is completed. Garcia owned and operated ACLF Medical Services and CARES, two companies which offered 23 Tampa Bay area adult congregate living facilities, what he called "structured recreational and leisure activities," which are required by state law. His staff visited each location, without cost to the facilities, but then billed health insurance programs instead for "psychiatric and psychotherapeutic services," federal prosecutors said.


Psychologist Convicted of Stealing Boys' School Fees of $32,000 May Lose License
New Zealand source: Sunday Star-Times, February 1, 1998
   Psychologist Wynton John Bradshaw, 52, has been convicted in District Court of stealing $32,697 from a school where he worked as a guidance counselor. The money was given to him by the Children, Young Persons and their Families Service to cover boarding, fees, and other costs for three boys he had placed at the school. Instead of paying the money to the school, he told them the CYPF Service had no funds to cover the boys' costs. Bradshaw claimed a long-time mental illness led him to steal, but the judge said he was lucky to escape a prison sentence. Bradshaw faces possible deregistration as a psychologist.


Harvard Psychiatrist Accused of Using False Credentials
Boston, Mass. source: Boston Globe, January 29, 1998
   Harvard psychiatrist, Dr. Gloria Johnson-Powell, who is in her 60's, is accused in Boston District Court of falsely representing that she was board-certified. The court also thought her affidavit claiming the adding of a board certification number to her resume was merely a clerical error, was "probably not true," and that the evidence of her past infringement of the trademark certification was "so strong as to be perhaps undeniable." The appellate court agreed that it could also be inferred from the record that Dr. Johnson-Powell violated past promises to reform her conduct.


Erik Menendez's Defense Psychiatrist Admits Unethical Deletion of Incriminating Statements
Los Angeles, Calif source: Los Angeles Times, March 29, 1998
   Harvard-educated psychiatrist William Vicary admitted to the California Medical Board that deleting potentially incriminating statements by Menendez was unethical, and for so doing, was allowed to keep his medical license. Vicary had testified during the second Menendez trial that he had changed his notes in 24 places after Menendez's attorney threatened to take him off the case if he didn't.


Fraud & Theft: Insurance Fraud Charges Filed Against Psychiatrist
Riverside, Calif source: Press-Enterprise, February 7, 1998
   Psychiatrist Dr. John M. Ravin, who allegedly treated workers' compensation patients out of a Corona hotel then billed insurance companies for more hours than a day is long has been charged with grand theft and insurance fraud. In some cases, state insurance investigators allege, Ravin and a partner billed for more than 50 hours of treatments in a single day.

Nevada Class Action Filed for 15 People Claiming they were Involuntarily Committed and Held in Private Mental Hospitals

   Under a state law called a Legal 97, anyone in Nevada exhibiting signs of mental illness can be picked up and held against his will in a mental institution. All it takes is for a spouse, parent, adult child, legal guardian, physician, psychologist, social worker or registered nurse to say you are mentally ill. The argument is usually that you are posing a threat to yourself or others around you. One case involves a woman who describes how she dropped by Charter Psychiatric Hospital to ask a few questions, pick up some brochures and be on her way to visit other mental health facilities. She says a divorce after a 15-year marriage had left her feeling melancholy and she needed to talk to someone. When she told the nurse at Charter she was shopping around for counseling, the nurse recommended Charter's 21-day in-house stay, offering to show her around the facility. When the nurse finished with the tour, the woman remembers her suddenly stepping back and saying she was sorry but that "it's out of my control," and two men in white coats were suddenly standing behind her. She said she asked, "You mean I can't leave?" and they told her "That's right," that she could either go quietly or they would strap her down. She says she was never so frightened in her life.


Legal Action Planned Against Psychiatrist who Prescribed Sleep Therapy

   Seven days of sleep destroyed my husband, says a woman whose husband went to see a psychiatrist because he was suffering from panic attacks. He was admitted to hospital for tests, and once phoned his wife wanting to leave the hospital. When she visited him that night, she says she found him heavily sedated and semi-naked and he'd fouled himself like a baby. The duty nurse told her he was receiving sleep therapy, and she says "I didn't even know what the words meant." After two weeks of treatment he was discharged without showing any sign of improvement. He had driven himself to hospital a year ago for the therapy and took a few books along to read, but since the therapy he hasn't driven or read again. In his garage is a half-completed glass-fibre sports car he was assembling. Now he spends up to 21 hours a day in bed, getting up with difficulty and shuffling to the toilet. Sleep therapy was banned in Australia after a commission of inquiry linked it to no fewer than 48 deaths. In America and Britain it's regarded as medical malpractice.


Shrinks can be Sued by Parents Falsely Accused in Child Sexual Abuse Cases

   Psychiatrists could wind up needing legal help if they misdiagnose children in sexual abuse cases. The state Superior Court ruled that psychiatrists were no longer immune from civil suits by parents falsely accused of abuse by their kids in counseling. The court ruled that the misdiagnosis of a 15-year-old girl by University of Pittsburgh psychiatrist Judith Cohen helped support the girl's false accusation that she had been sexually abused by her father.

Death of 15-Year-Old Girl After She was Restrained at Desert Hills Psychiatric Treatment Center is Probed as Homicide
Tucson, Ariz source: Arizona Daily Star and Tucson Citizen, February 11 and 19, 1998
   Detectives are investigating the death of a 15-year-old girl after she was restrained at a local psychiatric center, as a possible homicide or child abuse, according to a court affidavit. A pediatric care specialist told police that Edith Campos may have died from asphyxiation caused by "chest compression." According to the autopsy, "there is no apparent medical cause for her death, nor any known pre-existing physiological condition that would have contributed to her death." The mother of yet another girl reported that her teen was restrained and lost consciousness at the center in January, the affidavit states, and she received injuries to her rib cage and face. That girl complained of having pressure put on her chest. According to the autopsy on Edith Campos, "there were no physical or medical abnormalities found." Center staff members told police Edith became violent at the center, was restrained and stopped breathing. She went into a coma and died two days later without regaining consciousness. She had been at the psychiatric center about two weeks. Edith's older sister said she wasn't the problem child, but that she was sweet and helpful. Her mother said she got awards in school for always having a smile. Edith's parents took her to a San Diego psychiatric hospital for counseling last spring because she was misbehaving in school and they believed she was using marijuana and crystal methamphetamines, and that she wanted to get attention and increase her popularity at school.


Psychiatrist Accused of Malpractice in Patient's Suicide
Wilkes-Barre, PA Source: Times Leader, January 22, 1998
   Psychiatrist, Dr. Nicholas Danforth, allegedly failed to recognize the severity of depression of a farmer who was worried about the direction the family farm in New Berlin was taking. This misdiagnosis led to his suicide, claims his widow. Spangler, the farmer, shot himself in the head six days after allegedly being misdiagnosed by Danforth.
